What Can Prenuptial Agreements Cover
Under California law, in a premarital agreement, a future husband and wife may agree on any matter they wish, as long as the topic doesn't violate any law or public policy.
Specifically, prenuptial agreements cover the following issues:
1. the right and obligations in any of the property that they own; 2. the management and control of the property they own; 3. the disposition of their property upon divorce or even death; 4. the making of a will or trust; 5. life insurance proceeds; 6. the state whose laws will govern the agreement; and 7. virtually anything else they want.
Since a parent can't waive their child's support, spouses can never agree, however, on any child support obligation issue.
