Guideline calculation

There are three basic steps to determine the tentative child-support amount.

1. The court must determine each parent's net monthly disposable income.

To do that, the court will find the parent's annual gross income, divide by 12, and reduce the amount by certain specified deductions.

In calculating gross income, the court may consider the earning capacity of a parent's investment assets by computing a reasonable rate of return to the assets, even if they are not income producing.

After gross income is found, net disposable income is calculated by deducting certain expenses. These deductions are state and federal income taxes, social security contributions, union dues, health insurance, other child-support already being paid, and other job-related expenses.

2. Adjust the amount based upon the number of children support is being provided.

3. Adjust the amount based upon the approximate time each parent has primary physical responsibility of the child.

The more time you have primary physical responsibility of the child, the less you will be required to pay to the child's overall expenses. Thus, the less child support you will be required to pay.
