Factors to rebut presumption for child support


The amount of child support computed by the guidelines is presumptively correct. There are certain factors that may be used to rebut the presumption:

1. Parties can agree, subject to court approval, to a different amount.

2. The sale of the family residence is deferred and the rental value of the residence exceeds the combined cost to keep the house.

3. Payor has an extraordinarily high income.

4. Parent not contributing to meeting the child's needs at a level commensurate with custodial time.

5. Application of guidelines would be unjust or inappropriate due to special circumstances.
